EZE Ryders Test Ride Waiver

PLEASE READ CAREFULLY - THIS IS A LEGAL AGREEMENT

Test rides are a MAXIMUM of 10 minutes and rider must stay within 1,000 feet of the shop.

Are you under 18? If so, a parent or guardian must review and sign this waiver on your behalf.

In exchange for a short test ride on one of our products, you must execute our Test Ride Waiver "The Agreement" and you must acknowledge all of the following conditions:

lI want to ride, I am in sound mind and body to operate a motor vehicle, and I agree for myself and, if applicable, for the members of my family, to the following:

nCondition of the Vehicle: I acknowledge that I am responsible for inspecting the vehicle before the test ride. If I am not familiar with any features of the vehicle I will request instruction from a staff member. If I notice any thing on the vehicle that may prevent me from sefely riding, I will immediately stop, get off the vehicle, and ask a staff member for assistance.

nProduct Liability: I understand that I am fully responsible for any damages that occur to the vehicle during the test ride. This includes damages caused by misuse, negligence, or accidents.

nTheft: I agree not to leave the vehicle unattended during the test ride and will take all necessary precautions to prevent theft. In the event that the vehicle is stolen while in my possession, I will be held fully accountable for the full retail value of the and may be subject to legal action.

nReturn of the Bike: I agree to return the bike to the Shop within the agreed-upon time for the test ride, which is 10 minutes or less. I understand that an extension of the test ride duration is subject to the shop managers written approval and may incur additional fees. Without express written approval, without returning the vehicle within the approved time period will be considered theft of property and will be subject to legal action including reporting the vehicle stolen to the police and pursuing criminal charges where applicable by law.

I agree that I am responsible for knowing how to properly ride and operate the vehicle, and/or for requesting needed instruction.

I will wear a helmet at all times while test riding.

I will follow all traffic and vehicle code rules and regulations.

I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by any EZE Ryders Party.

With regard to use of motorized vehicles of any type, I have:

NO physical or mental condition that prevents me from so operating.

NOT consumed alcohol nor am I under the influence of any drugs or substances that would impact my ability to operate a motorized vehicle.

I agree that I am solely responsible for my health and safety, and certify that I have the experience, skill and ability necessary to ride a motorized vehicle.

I agree to use this form as a digital signature which shall be binding on me as if any signed original. By entering my information above I certify that I am of legal age, 18 years of age or older, and of sound mind and body to enter into this legal contract. I agree that I have read this Agreement and fully understand the content contained herein.

Assumption of Risks and Release:

I hereby assume the risk of all of the above-mentioned risks, hazards and dangers, and any harm, injury or loss that may occur to me or my property as a result of my use or test of an EZE RYDERS vehicle or EZE RYDERS supplied equipment including, but not limited to, any risks, hazards or dangers caused by the negligence of EZE RYDERS and each and all of its shareholders, directors, officers, managers, members, employees, landlords, insurers, attorneys and agents (collectively, the “EZE Ryders Parties”).

I expressly further release and discharge all EZE Ryders Parties for injury, loss or damage arising out of my or my family's use of an EZE Ryders vehicle or any associated equipment used therewith, whether caused by the fault of myself, my family, an EZE Ryders Party or any other third party. This release includes, but is not limited to, claims based on: negligence; defects in the design, manufacture, adjustment, maintenance or inspection of the EZE Ryders motorbike and related equipment; failure to provide, inspect, or maintain the area where the EZE Ryders motorbike is ridden; and failure to provide proper instruction, technical direction or safety equipment.

I agree NOT TO SUE or make a claim against the EZE Ryders Parties for injuries or damages relating to use of the EZE Ryders motorbike and related equipment. This Section does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that California law does not permit to be excluded by agreement.

I promise to INDEMNIFY, HOLD HARMLESS AND DEFEND the EZE Ryders Parties against any and all claims related to EZE Ryders vehicles or provided equipment, including claims for their own negligence. I also promise to INDEMNIFY, HOLD HARMLESS AND DEFEND the EZE Ryders Parties against any and all claims for my own negligence, and any other claim arising from my use of the EZE Ryders motorbike or related equipment.

In accordance with these promises, I will reimburse the EZE Ryders Parties for any damages, reasonable settlements and defense costs, including attorneys’ fees, they may incur because of any such claims made against the EZE Ryders Parties. I agree that in the event of my death or disability, the terms of this Agreement, including the indemnification obligation in this Section, will be binding on my estate, and my personal representatives, executor, administrator or guardian will be obligated to respect and enforce them.

I agree that the purpose of this Agreement is that it shall be an enforceable release of liability and indemnity as broad and inclusive as is permitted by California. I also agree that any invalid provision will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of the Agreement.

This Agreement is governed by and construed in accordance with the laws of the state of California, without any reference to choice of law rules. In any litigation in which the validity or enforceability of this Agreement is contested, I agree that any party contesting the Agreement will pay all attorneys’ fees and costs of the parties seeking to uphold the Agreement. I have fully informed myself of the content of this Agreement by reading it before signing it. I agree that no oral representations, statements or other inducements to sign this release have been made apart from what is contained in this document.

I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire.
